Revocation of Licence
Under Section 32 of the Real Estate Agency Act, 2020 (Act 1047), the Real Estate Agency Council (REAC) has the authority to revoke the licence of a broker, agent, or real estate firm where serious breaches of the law, professional misconduct, or disqualification grounds are established.
Grounds for Revocation
- Obtaining a licence by fraud, misrepresentation, or concealment of material facts.
- Conviction of an offence involving dishonesty, fraud, or moral turpitude.
- Engaging in conduct detrimental to the integrity of the real estate profession.
- Persistent breach of the Code of Conduct or the provisions of Act 1047.
- Failure to rectify issues that led to a prior suspension within the period allowed.
Procedure for Revocation
- The Council notifies the licence holder in writing, specifying the reasons for proposed revocation.
- The licence holder is given a fair opportunity to respond and appear before the Council.
- After due consideration, the Council may revoke the licence if the evidence supports the allegations.
- A copy of the revocation decision is served on the licence holder and recorded in the official register.
Effects of Revocation
- The individual or firm shall immediately cease to operate as a real estate broker, agent, or company.
- The revoked licence must be returned to the Council without delay.
- Any continued practice after revocation constitutes an offence punishable under Act 1047.
- The Council may publish the revocation in the national register or official gazette for public notice.
Re-Application After Revocation
- A person or firm whose licence has been revoked may, after two years, apply to the Council for a new licence.
- The applicant must demonstrate full compliance with all provisions of Act 1047 and rehabilitation of conduct.
- Re-issuance is at the sole discretion of the Council, based on the applicant’s credibility and conduct record.
