Suspension of Licence
Under Sections 33 to 35 of the Real Estate Agency Act, 2020 (Act 1047), the Real Estate Agency Council (REAC) has the authority to suspend the licence of any broker, agent, or firm found to have breached professional conduct, failed to comply with the Act, or engaged in unethical practices within Ghana’s real estate industry.
Grounds for Suspension
- Providing false or misleading information during registration or renewal.
- Engaging in fraudulent or dishonest real estate transactions.
- Failure to pay prescribed fees or renew a licence as required under the Act.
- Violation of the Code of Conduct or other directives issued by REAC.
- Conviction of an offence related to fraud, dishonesty, or moral turpitude.
Procedure for Suspension
- Upon identification of misconduct or non-compliance, REAC issues a Notice of Suspension to the licensee, stating the reasons and duration.
- The licensee shall be given an opportunity to respond or appear before the Council within a specified period.
- After review, the Council may confirm, vary, or revoke the suspension based on the findings.
- The suspension shall be published in the REAC Register and on the official REAC website in accordance with Section 35 of Act 1047.
Effect of Suspension
- During suspension, the affected broker, agent, or firm shall cease all real estate practice until the suspension is lifted.
- It is unlawful to conduct or advertise real estate business while under suspension.
- Licences may be reinstated only after compliance with REAC’s directives and completion of disciplinary or corrective measures.
All practitioners are encouraged to maintain professional integrity, comply with the Act, and uphold ethical standards to prevent disciplinary actions that may lead to suspension or revocation of licence.
