Disciplinary Action

Under Sections 29 to 33 of the Real Estate Agency Act, 2020 (Act 1047), the Real Estate Agency Council (REAC) is empowered to take disciplinary action against licensed real estate practitioners, brokers, or firms who breach the provisions of the Act, engage in professional misconduct, or fail to comply with the Code of Conduct governing the real estate profession in Ghana.

Purpose of Disciplinary Action

  • To uphold integrity, transparency, and accountability in real estate transactions.
  • To protect the public and clients from unethical or fraudulent practices.
  • To ensure that only qualified and compliant practitioners operate within the regulated industry.
  • To enforce the standards of professional conduct as prescribed by REAC.

Types of Disciplinary Action

Depending on the nature and severity of the offence, the Council may impose any of the following disciplinary measures:

  • Suspension of Licence – Temporary restriction from practice for a specific period.
  • Revocation of Licence – Permanent withdrawal of licence following serious misconduct.

Procedure for Disciplinary Hearings

  1. Receipt and review of complaints or reports of misconduct.
  2. Notification to the practitioner of alleged breaches.
  3. Formal hearing before the Council’s Disciplinary Committee.
  4. Issuance of sanctions or clearance based on findings.
  5. Right to appeal as provided under Section 34 of Act 1047.

All disciplinary actions are carried out with fairness, due process, and in accordance with Ghanaian law and professional ethics. Practitioners are encouraged to maintain continuous compliance and integrity in service delivery.
